THE PROTECTION OF PLANT VARIETIES AND FARMERS’ RIGHTS ACT, 2001 ACT NO. 53 OF 2001
An Act to Establish an Effective System for Protecting Plant Varieties, Farmers’ and Plant Breeders’ Rights, and to Promote the Development of New Plant Varieties.
WHEREAS it is deemed vital to acknowledge and defend farmers’ rights in light of their ongoing commitment to the preservation, advancement, and availability of plant genetic resources for the creation of new plant varieties;
And considering that in order to encourage investment in research and development for the creation of new plant varieties, the rights of plant breeders must be protected in order for the country’s agricultural growth to advance;
And although such safeguards will encourage the development of the nation’s seed business, ensuring that farmers have access to high-quality seeds and planting supplies;
And considering that in order to achieve the aforementioned goals, steps to protect the rights of farmers and plant breeders must be taken;And whereas India should establish provisions for implementing subparagraph (b) of paragraph 3 of article 27 in Part II of the said Agreement, which deals with the protection of plant varieties, after ratifying the Agreement on Trade-Related Aspects of Intellectual Property Rights.
